These Terms of Service govern access to and use of PrimeSite AI (“PrimeSite AI”, the “Platform”, the “Service”, “we”, “us” or “our”).

Depending on the product, service, checkout, invoice or transaction presented to you, either Sell More With Video LTD or Prime Web Consulting LLC may act as the contracting entity and/or payment recipient. The applicable entity may be identified during checkout, on the payment page, receipt, invoice or other transaction documentation.

1. THE SERVICE

PrimeSite AI is an AI-powered software platform providing website creation, AI-assisted content and image generation, business tools, lead and business discovery functionality, website management, digital resources and related services.

The features available to you depend on your plan, purchases, usage allowances and any additional products or services you acquire.

Some functions depend on third-party technology, APIs, hosting services, artificial intelligence providers, payment processors, mapping or business-data providers and other external services.

2. ELIGIBILITY AND ACCOUNTS

You must be legally capable of entering into a binding agreement to use paid services.

You are responsible for providing accurate account information, protecting your login credentials and all activity performed through your account.

You must promptly notify us if you believe your account has been accessed without authorisation.

3. AI-GENERATED CONTENT

PrimeSite AI may generate text, images, website content, suggestions, analyses, recommendations and other materials using artificial intelligence.

Artificial intelligence can produce inaccurate, incomplete, inappropriate or unexpected results.

You are responsible for reviewing generated output before publishing, distributing, sending or otherwise relying upon it.

We do not guarantee that AI-generated content is unique, error-free, legally compliant or suitable for a particular business, industry, jurisdiction or purpose.

4. USER CONTENT

You retain your rights in content and materials you submit to PrimeSite AI.

You grant us and the service providers used to operate PrimeSite AI the rights reasonably necessary to process your content solely for providing, securing, maintaining and improving the Service, subject to applicable law and our Privacy Policy.

You represent that you have the necessary rights and permissions for content, trademarks, images, business information or other materials you upload or provide.

5. ACCEPTABLE USE

PrimeSite AI must not be used to:

- violate applicable laws or regulations;
- infringe intellectual property or privacy rights;
- conduct fraudulent or deceptive activities;
- distribute malware or harmful code;
- obtain unauthorised access to systems, accounts or data;
- abuse, overload, manipulate or interfere with the Platform;
- generate or distribute unlawful content;
- impersonate another person or organisation without authority;
- use business or contact information in violation of applicable marketing, privacy or communications laws.

We may restrict or suspend access where reasonably necessary to address fraud, abuse, security threats, non-payment or material violations of these Terms.

6. BUSINESS SEARCH AND CONTACT FEATURES

PrimeSite AI may provide tools that assist users in discovering publicly available business information or preparing business communications.

Availability of business information does not mean that a person or organisation has consented to receive marketing communications.

You are responsible for ensuring that your use of contact information and your communications comply with all laws applicable to you and the recipient, including privacy, electronic communications, anti-spam and direct-marketing requirements.

7. PLANS, PRICING AND PAYMENTS

Prices, plan features and applicable usage allowances are displayed before purchase.

Payments may be processed through third-party payment providers such as Stripe.

The legal entity identified at checkout, on the payment record, invoice or receipt will normally be the entity responsible for that particular transaction.

You authorise the applicable payment processor to charge the payment method selected by you for purchases you make.

8. SUBSCRIPTIONS

Where a product is sold as a recurring subscription, the billing frequency and price will be displayed before purchase.

Unless cancelled in accordance with the applicable subscription terms, recurring subscriptions may renew automatically where disclosed and permitted by applicable law.

You may cancel future renewals through the available account functionality or by contacting us where applicable.

9. AI CREDITS AND USAGE ALLOWANCES

Plans may include AI generations, credits, searches, storage, website capacity or other usage allowances.

Additional usage or credits may be available for purchase.

Usage allowances have no cash value and may not be transferred or resold unless expressly permitted.

Limits and features may vary between plans.

10. THIRD-PARTY SERVICES

PrimeSite AI integrates with services operated by independent third parties.

Those services may be subject to separate terms, availability restrictions and privacy policies.

We cannot guarantee uninterrupted availability of third-party services or APIs.

11. SERVICE AVAILABILITY

We aim to maintain reliable availability but cannot guarantee that PrimeSite AI will operate continuously or without errors.

Maintenance, updates, internet failures, third-party outages, API changes, security events and circumstances outside our reasonable control may affect availability.
